# Terms of use and legal notice

These terms apply to [komunitin.org](https://komunitin.org), its application and associated APIs. They do not apply to CES or other instances of the Komunitin platform.

## Platform operator

## Service and community currencies

Komunitin provides a community currency wallet and a marketplace for publishing offers and wants and recording exchanges. The service supports mutual aid, cooperation and sustainability in communities operating without profit-making in management.

The platform operator provides the technical infrastructure. Members agree and carry out exchanges directly with each other and are responsible for the goods and services they provide.

Community currency units record contributions and exchanges. Balances represent a member's position in the community's mutual-credit system; they are not deposits or investments and give no right to reimbursement, goods or services from the platform operator. Each community defines its unit, account limits, participation rules and arrangements for exchanges with other communities.

## Membership and accounts

Communities decide admission and provide their participation rules before members join. Members must have the legal capacity or representative's authorisation needed to participate. Anyone acting for an organisation or shared account must be authorised and identify its responsible representative.

Members must keep registration and contact details accurate, protect their credentials and use only accounts they are authorised to operate. Report suspected misuse and incorrect records to the community administrator or <info@komunitin.org>.

Members must check the participant, amount and description before submitting a transfer. Corrections must preserve an accurate exchange history and the rights of the participants.

## Exchanges and content

Members must keep listings current, describe offers and wants accurately, and agree the scope, value and conditions of each exchange. They are responsible for applicable tax, professional, licensing, insurance, safety, employment and consumer obligations. Members acting professionally must identify that status and provide the information and protections required by law.

The following uses are prohibited:

* Illegal or fraudulent listings, threats, harassment, discriminatory abuse and infringement of others' rights.
* Unlawful disclosure of personal or confidential information and unsolicited advertising using member contact details.
* Impersonation, falsification of records, account manipulation and misuse of administrative access.
* Unauthorised access, malicious software and interference with the service.

Authors retain their rights in submitted content and authorise the platform operator to store, format, reproduce and display it for the service's publishing and notification functions. The [Privacy policy](/project/privacy.md) governs personal-data processing and retention.

## Reports and moderation

Send reports of unlawful content, abuse or security problems to <info@komunitin.org>. Include the content's URL or identifier, the reason for the report, and your name and email address, except where the law permits anonymity. For illegal-content reports, confirm that the information is accurate and complete to the best of your knowledge.

## Closing an account

You can close your account yourself from Settings when your balance is zero or positive. Any remaining positive balance is transferred to the account you select. Rights and duties from earlier exchanges continue after closure. Data-protection requests are handled independently of disputes about balances.

## Software and privacy

Komunitin software is distributed under the GNU Affero General Public License, version 3.0, as specified in the [source code repository](https://github.com/komunitin/komunitin). Rights granted by that licence remain in force.

## Shared maintenance

Each community using the hosted service contributes collectively to hosting, service administration, software maintenance and development. The community is responsible for organising its contribution and explaining any arrangements affecting its members.

The minimum contribution is **0.1 HOUR per account per year**: a community with 100 accounts contributes 10 HOUR annually. HOUR is the reference unit used to compare community currencies. The number of exchanges does not affect the contribution.

Contributions support the maintenance and development of the service and can be made in the community's own currency when external transfers are enabled. Community administrators can [contact the platform operator](mailto:info@komunitin.org) to agree the arrangements. The platform operator will communicate changes to contributions to affected communities in advance.

## Data protection responsibilities

For community data processed through the hosted service, each community's responsible organisation or identified representatives act as the **data controller**, with primary responsibility for members' personal data. The community decides which data to collect, who can access it and how long to keep it. It must establish a lawful basis, inform members and handle their data-protection requests.

The **platform operator** identified above acts as **processor** for community data and follows the community's documented instructions to provide the service. It assists with members' data-protection requests, notifies the community of personal-data breaches, and returns or deletes data at the community's direction when hosting ends, subject to legal retention requirements. ## Applicable law

Spanish law governs the hosted service, together with mandatory protections applicable to members, including consumer and data-protection rights. Each party remains responsible under applicable law. Disputes are heard by the courts competent under that law.
